Rental Agreement Terms

Important Notice
This Rental Agreement ("Agreement") is a legally binding contract between you ("Lessee," "Customer," or "you") and HeaterRental.com ("Lessor," "Company," or "we"). By submitting a rental request or accepting delivery of equipment, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions herein.
1 Definitions
- "Equipment" refers to any heater, heating unit, accessory, fuel tank, ducting, or related item rented from HeaterRental.com.
- "Rental Period" means the time from delivery/pickup to return/collection of Equipment.
- "Job Site" refers to the location where Equipment will be used as specified in the rental order.
- "Rental Rate" means the daily, weekly, or monthly charge for Equipment use.
2 Equipment Use & Restrictions
The Lessee agrees to:
- Use Equipment only for its intended purpose as described in manufacturer specifications
- Operate Equipment in accordance with all applicable local, state, and federal laws and regulations
- Ensure only trained and qualified personnel operate the Equipment
- Not modify, alter, or tamper with Equipment in any way
- Not sublease, loan, or transfer Equipment to any third party
- Keep Equipment at the designated Job Site unless written permission is obtained for relocation
Prohibited Uses: Equipment shall NOT be used in confined spaces without proper ventilation, near flammable materials, or in any manner that violates OSHA or local fire safety codes.
3 Indemnification & Hold Harmless
The Lessee agrees to indemnify, defend, and hold harmless HeaterRental.com, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- The Lessee's use, operation, or possession of the Equipment
- Any personal injury or property damage caused by or related to the Equipment during the Rental Period
- Fire, explosion, carbon monoxide exposure, or other incidents resulting from Equipment operation
- Placement of Equipment in inappropriate locations (e.g., too close to tarps, flammable materials, or combustible structures)
- Failure to provide adequate ventilation for fuel-burning equipment
- Any violation of applicable laws, regulations, or safety codes
- Claims made by third parties, including the Lessee's employees, contractors, or invitees
4 Ventilation Requirements (Critical Safety Clause)
CARBON MONOXIDE WARNING
For all diesel, propane, kerosene, and other fuel-burning heaters, the Lessee acknowledges and accepts FULL RESPONSIBILITY for:
- Providing adequate fresh air ventilation to prevent Carbon Monoxide (CO) buildup
- Following all manufacturer guidelines for minimum ventilation requirements
- Installing and monitoring CO detectors in heated spaces
- Ensuring exhaust gases are properly vented to the exterior
- Never operating direct-fired heaters in completely enclosed spaces without proper air exchange
FAILURE TO PROVIDE ADEQUATE VENTILATION CAN RESULT IN SERIOUS INJURY OR DEATH. HeaterRental.com is not liable for any injuries, deaths, or damages resulting from improper ventilation.
5 Fuel Policy
Unless otherwise specified in writing, the following fuel policy applies:
Standard Policy: "Out Empty, Back Empty"
Equipment is delivered with minimal fuel. Lessee is responsible for all fuel during the rental period. Return Equipment with minimal fuel remaining.
Alternative: "Out Full, Back Full"
When specified, Equipment is delivered with full fuel tank. Lessee must return with equivalent fuel level or pay refueling charges.
Note: Only use fuel types specified for the Equipment. Using incorrect fuel voids all warranties and the Lessee assumes full liability for resulting damages.
6 Damage, Loss & Theft
The Lessee is responsible for the Equipment from delivery until return. This includes:
- Damage: Any damage beyond normal wear and tear, whether caused by misuse, accident, neglect, or acts of third parties
- Theft: Full replacement cost if Equipment is stolen while in Lessee's possession
- Vandalism: Costs to repair or replace Equipment damaged by vandalism
- Environmental Damage: Damage from exposure to elements if Equipment is not properly sheltered
Lessee agrees to notify HeaterRental.com within 24 hours of any damage, theft, or loss.
7 Security Deposit
A security deposit or credit card pre-authorization may be required:
- Deposit amounts vary based on Equipment value and rental duration
- A pre-authorization hold will be placed on the provided credit card
- Deposits are released within 48 hours after successful Equipment inspection upon return
- Deposits may be applied toward damage repairs, missing accessories, cleaning fees, or outstanding rental charges
Typical deposit amounts range from $250 to $2,500 depending on Equipment type and value.
8 Insurance Requirements
Commercial/business rentals require proof of insurance:
- General Liability Insurance: Minimum $1,000,000 per occurrence / $2,000,000 aggregate
- Inland Marine (Equipment) Coverage: Equal to or exceeding Equipment replacement value
- HeaterRental.com must be named as "Additional Insured" and "Loss Payee"
Certificate of Insurance (COI) must be uploaded during checkout or emailed to [email protected]. Orders will be held pending COI verification.

9 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- HeaterRental.com's total liability shall not exceed the amount of rental fees actually paid by the Lessee
- HeaterRental.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- HeaterRental.com is not liable for business interruption, lost profits, or delays caused by Equipment malfunction
- All Equipment is provided "as is" – no warranties beyond those expressly stated herein
Some jurisdictions do not allow certain limitations of liability. In such cases, limitations apply to the fullest extent permitted by applicable law.
10 Governing Law & Dispute Resolution
This Agreement shall be governed by the laws of the state where the Equipment is delivered. Any disputes shall be resolved through:
- Good faith negotiation between the parties
- Mediation administered by a mutually agreed-upon mediator
- Binding arbitration in accordance with applicable state rules
11 Acceptance of Terms
By submitting a rental request, signing a rental contract, or accepting delivery of Equipment, you acknowledge that you have read this Rental Agreement in its entirety, understand its terms, and agree to be legally bound by all provisions herein. This constitutes a legally binding "Click-Wrap" agreement.
